Probate in New York refers to a legal proceeding conducted in the Surrogate’s Court for the purpose of validating the decedent’s Last Will and judicially appointing the Executor named therein to administer and settle the estate. If an individual dies without leaving a Last Will and Testament, that person is said to have died “intestate” and legal proceedings will similarly be commenced in the Surrogate’s Court with distribution of assets in accordance with New York State Law.
